The landscape of Ohio politics experienced a significant shift today, but our mission remains unshakeable. With the news of Attorney General Dave Yost’s resignation, many are asking what this transition means for the advocacy we have spearheaded. ​

Since 2021, we have maintained a steadfast presence. Through ten rejections and a historic battle in federal court, we have fought for the fundamental right of every Ohioan to hold their government accountable. 

We have been waiting since December 5, 2025—a total of 153 days—for Honorable Judge Graham to release the Permanent Injunction in Brown v. Yost. This ruling is destined to conclude the era of gatekeeping regarding our constitutional rights. 

​Voices from the Bench: The Road to Justice ​

Our fight has been validated by the highest legal minds in the country. From the District Court to the Supreme Court, the judiciary has recognized the unconstitutional hurdles we have faced.

​Honorable Senior Judge Graham (U.S. District Court): Judge Graham recognized the "irreparable harm" caused by the state’s delays, noting that the "fair and truthful" certification process, as applied, created a barrier that prevented us from reaching the voters. His upcoming Permanent Injunction is the final step in ensuring this "gatekeeping" power is dismantled for good. ​

The Sixth Circuit Court of Appeals: In a landmark opinion, the court wrote that the Attorney General’s repeated rejections constituted a "severe burden on core political speech." The court noted that by exercising "editorial control" over our summaries, the state was effectively forcing us to alter our message, a direct violation of the First Amendment. ​

En Banc Hearing: During the full court review, the Sixth Circuit emphasized that the lack of "timely judicial review" in Ohio’s system allowed the executive branch to kill initiatives by simply running out the clock—a tactic the court found fundamentally incompatible with democratic principles. ​

The United States Supreme Court: The scrutiny from the highest court in the land, including the denial of the state's request for a stay in April 2025, underscores that the right to petition is not a suggestion—it is a mandate. ​

The Importance of This Historic Precedent ​

This case is not just a local dispute; it is a national landmark for constitutional law. The precedent we are setting establishes three vital pillars for the future. 

​Constitutional Primacy over Administrative Discretion: This case establishes that a state official cannot use "summary review" as a functional veto. It proves that administrative processes must yield to First Amendment rights. ​

Protection of Core Political Speech: By winning this fight, we have ensured that "editorial control" by the government over citizen petitions is recognized as unconstitutional censorship. ​

The End of "Pocket Vetoes": This precedent ensures that no official can simply delay a petition into oblivion. It mandates a path for "timely judicial review," ensuring that the clock cannot be used as a weapon against the people. ​

Regardless of who succeeds the outgoing Attorney General, the Protecting Ohioans’ Constitutional Rights initiative continues its progression toward the 2026 ballot. ​We also carry a heavy heart today for our Executive Director, Kyle Pierce, who continues his recovery and rehabilitation following a severe accident. Kyle’s dedication is woven into the very fabric of this amendment; we persevere in this fight for him, for our families, and for the future of Ohio. ​

The "Architect" always has a plan. We remain present, we remain resolute, and we will not falter until the rights of the people are fully secured. ​
